But that slur was in the service of a larger point about the shortcomings of democracy that was, if anything, even more astonishing. “Whenever a society adopts racial entitlements, it is very difficult to get out of them through the normal political processes,” Scalia said. “I don’t think there is anything to be gained by any senator to vote against continuation of this act.” Scalia was arguing that the only reason Congress reauthorized by a lopsided vote the most successful civil rights law in history is that no one wanted to seem racist, and that as a result, racial issues shouldn’t be left to the democratic process at all.
