Hotham figured it would be only a matter of time before weaknesses emerged that he and Commissioner Rede might exploit to their advantage, but as it turned out, a rapid succession of events brought matters to a head. On November 23, James Bentley was convicted of the manslaughter of Scobie after a retrial. This was welcomed by the miners, but any prospect of being placated was dashed by the November 25 conviction of the three men – Fletcher, McIntyre and Westerby – arrested after the burning of the Eureka Hotel. They were not convicted of arson but of inciting a riot. On the same day, the Ballarat Times, a newspaper sympathetic to the miners, published an article deemed seditious by Commissioner Rede, who was becoming increasingly alarmed by the mood at the diggings. Two days later, Humffray, Black, and Kennedy met with the governor with a message from the League demanding the three men’s immediate release.
