If there is any doubt, the male candidate must have an opportunity to provide more information that might tip the scale in his favor. Human resources experts recommended that any employer hiring a woman keep extensive records about how and why the decision was made, just in case it was challenged by the male.

And then the government was actually surprised when, five years later, no employers had used the tiebreaker.

The British approach relies heavily on the expectation that employers make objective judgments, which presumes bosses are aware of their own potential for bias, as well as the certainty that any judge would make the same call. If you lined them all up, studies that prove gender bias systematically affects employment evaluations probably would circle the globe. They are usually some version of this:

You have a false set of CVs, some identified as belonging to females and some to males.

You give them to a group of employers and ask them to evaluate and choose the top candidate.

Then you swap the male and female CVs, such that each “candidate” has a CV that belonged to the opposite sex before.

You get another evaluation.
