Structuring the resolution process

Although it is important to allow a degree of flexibility in the resolution process, taking account of the fact that people may have specific preferences and things may change, it is also helpful to start with a plan of how the process might work. Essentially, this will work through a series of individual and joint meetings and in some cases by the resolution agent passing information from one party to another.

It is helpful to set out the options that you might follow to the parties so that they will be aware of what you are doing when you are doing it. You might also want to say at the beginning that you may need to spend more time with one party than the other and this will not be because you are on one party’s side more than the other but rather to explore the issues in an effort to support both.

Holding individual meetings

First, set up times to have individual meetings with each of the parties before bringing them together. This is crucial for the following reasons:

It develops a relationship of trust and confidence with each of the parties.

It helps them identify key issues and priorities.

It helps them work out what they want to say to the other person.

It evaluates whether there is room for the parties to talk.

It identifies potential common ground.

It identifies potential areas of non-agreement.

It establishes whether the resolution agent is the best person to help the parties.
