SO SUE ME!

There are two types of offences in South African law: criminal offences and civil offences. So, having just covered criminal capacity, it seems sensible to fill you in on civil capacity, too.

Criminal offences can pack you off to jail, but civil law is non-criminal law, so it does not have the same consequences. Civil cases (e.g. defamation, infringement of privacy, breach of copyright, etc.) might not result in your going to jail, but they can lead to you being sued for lots and lots of your lovely money. In South Africa, a child can be sued in their own name from the age of seven. The court papers for the proceedings will be sent to your parents or guardians, but it is still very much you being sued.

So, if you are planning on getting sued sometime soon, we suggest you get a decent part-time job, as getting sued tends to be a costly business …

NB: Teachers sue their pupils surprisingly often. So don’t defame your teachers or infringe on their privacy. You have been warned!
