Non-Compete

If the candidate happens to be from within the industry, I take a moment to ask them if they’re bound by any non-compete agreement with their employer (or, if they recently left the employer, whether there’s one still in effect—often they’re one or two years in duration). Why? Because I’ve fallen in love with far too many candidates only to find out late in the game that they were un-hirable (or at least not without a lawsuit). So, ask early. The answer may surprise you.
