Relations with Sub-entities and National Institutions

Besides the direct participation of representatives of Member States and/or national governments in the European Council and the EU Council and national central banks in the Governing Council of the European Central Bank,21 three national institutions and sub-entities enjoy structured relationships with the institutions of the Union: national parliaments, courts, and regions and local bodies—via direct participation in the decision-making process of the Union, or in the implementation of EU acts by national parliaments22 and national administrations (TFEU, 2007, art. 197, 291[1]), the performance of advisory functions of representatives of regional and local bodies via the Committee of the Regions (TFEU, 2007, art. 300[3], 307), or via specific cooperation between national courts and the ECJ for the purpose of interpretation and judicial control of EU acts via the preliminary ruling procedure (TFEU, 2007, art. 267).

These relationships are intended to give privileged voice to diversity or to ensure uniform application of EU law among the various actors. They do not, however, imply any tradeoff between unity and diversity, because the autonomy of the common institutions remains intact. The efficient interplay among the various actors that represent diversity and those that participate in the expression of the common interest is safeguarded by the constitutionally guaranteed autonomy of the EU institutions and by procedures that have constantly been adjusted for the optimal performance of this function.23
