Box 13.1 Situation

Augusta is a palliative care nurse who visits patients in the community advising them, their relatives and GPs on their care, and arranging admissions to the hospice when appropriate. One patient is in the terminal stages of renal failure and on high doses of morphine. She is clearly in considerable discomfort and Augusta is asked by the patient if she could increase her dose. The patient does not wish her relatives to be told. Augusta is anxious to do this as soon as possible, since it may be several hours before the GP is able to visit. She phones the GP who tells her that she can give an additional dose and he would write it up later. Augusta administers this additional dose. Before the doctor has written up the additional dose, the patient dies. The relatives are now claiming that Augusta killed the patient. What is the law?
