9.2.5.2.3. Arbitral seat and language

The location of an arbitral seat is chosen by the Board, unless agreed upon by the parties. 95

The language of the proceedings is determined by an arbitral tribunal; however, the parties may reach agreement on which language to use. 96

9.2.5.2.4. Confidentiality 97

Arbitration proceedings and awards as conducted under the SCC Rules are confidential, unless otherwise agreed by the parties. This feature refers only to the SCC and any arbitral tribunal convened. The parties are not covered by the confidentiality clause.

The SCC publishes articles where selected extracts of awards are published. Some of the articles include summaries of decisions regarding challenge of arbitrators and decisions on jurisdiction. The names of arbitrators, parties or their counsel are removed, however.
