9.11 What happens if my spouse files bankruptcy during our divorce?

Contact your attorney right away. The filing of a bankruptcy while your divorce is pending can have a significant impact on your divorce. Your attorney can advise you whether certain debts are likely to be discharged in the bankruptcy, the delay a bankruptcy may cause to your divorce, and whether bankruptcy is an appropriate option for you.

9.12 Can I file for divorce while I am in bankruptcy?

Yes. In some situations this may be in your best interests because a bankruptcy acts as an automatic stay, which prevents your creditors from pursuing their attempts to collect the money they are owed. It may even be in your and your spouse’s best interests to file a joint bankruptcy petition.

9.13 What should I do if my former spouse files for bankruptcy after our divorce?
