9.1.4

Liquidated Damages

The parties acknowledge and agree that the damages that are to be expected as a result of a material breach of contract by the Contractor may be uncertain in amount and very difficult to prove. In that event, the parties do intend and in fact now agree, if necessary, to liquidated damages in advance and stipulate that the amount set forth in this section is reasonable and an appropriate remedy as liquidated damages and not as a penalty. If the Contractor materially breaches the contract, then the Contractor shall pay the Agency the daily amount indicated for liquidated damages in the variable information table for the duration of the delay.

Liquidated damages pertain to reimbursement of costs incurred by the agency should the contractor fail to complete its contractual obligations on time due to a material breach of contract.
