Where early searches can result in a large dataset, complex analysis and a broad range of information, they will hopefully lead the innovative ideas into a better-defined objective. That objective may well include seeking patent protection. In order to be in the best possible shape to have a patent granted, a patentability search can help to ensure that there are no surprises when filing and the search step is undertaken.24
A small-scale search, the patentability search aims to highlight disclosures that may affect what protection can be gained. It will look for references that already describe the invention, or that represent the closest prior art that may then be deemed to preclude the new invention as an obvious progression, destroying the inventive step.25
When taken into account, the results from patentability searches can be an essential tool for deciding whether to seek protection at all, but also to those who may be drafting the claims of a patent application. The closest related art will give an indication as to what the scope of the application can be, and what areas need to be avoided.
