In such an environment the state, which will ensure the transition to civil society, is obliged to protect some natural rights individuals had in the state of nature. By describing these rights as the right to life, freedom, and property rights, Locke imposes the state on three main tasks which are âabiding by main elements of civil law derived from natural lawâ, âapplying rules for protection of property in terms of exercising freedomâ, and âmaintaining defense of the people against external interferenceâ (Ibid: 155). Hence, the Lockean formulation of freedom in political life or civil society is directly located between the notion of private property and state. In other words, Lockean formulation of freedom based on private property also determines the main tasks of the state in general sense and of positive laws in a narrow sense. As one of the earliest theoreticians of modern understanding of negative freedom like Hobbes, Locke claims that a man can only be free if two main conditions are satisfied which are:
To have a power in order to be an agent in terms of doing or forbearing any particular action, as he puts it; So that the Idea of Liberty, is the Idea of a Power in any Agent to do or forbear any particular Action, according to the determination or thought of the mind, whereby either of them is preferrâd to the other.
