In my political science courses, I ask my students whether they think the Supreme Court should reflect the will of the people or rise above it, if doing so is right. The overwhelming majority of my students believe the Supreme Court should rise up and do the right thing. It was the controversial rulings of the Warren Court that embraced civil rights and civil liberties in the 1950s and 60s and changed the course of this nation. If the Supreme Court does not consistently interpret the Constitution as a document that protects the rights of all citizens from haphazard and unfair treatment, then a serious problem exists in this society. Even those on the fringe should be shielded by the Constitution from draconian policies.
