The charter defines seven general principles likely to contribute to “the quality and competitiveness of the kilowatt/hour”:

•

transparency of job propositions to service companies;

•

developing operators’ sense of professionalism;

•

improving work plan visibility;

•

reducing individual and collective radiation dose;

•

improving risk prevention;

•

improving working and living conditions;

•

follow-up.

The most tangible measure in the partnership involves the signing of pluri-annual contracts. The other charter points primarily lay down the demand for high-quality organizing of unit shutdowns without giving any specifications about the means to be used to satisfy that demand. The charter was drafted and signed without consulting representatives of either EDF or the subcontracting companies.

In reality, whereas the partnership policy initiated by EDF was first officially implemented in 1993, pluriannual contracts have only been signed for a small proportion of subcontracted work; namely, operations carried out by companies that have direct job deals with EDF. As we know, there is also the practice of sub-subcontracting, where subcontracted companies subcontract part of their work to their own subcontractors. The provisions of law no. 75–1334 of December 31, 19754 on subcontracting raise a serious question, and it is worthwhile quoting in full Article 3 of this law, which addresses the matter of sub-subcontracting:

The company (subcontracted by the principal) that intends to execute a contract or an agreement by means of one or several subcontractors must have each subcontractor accepted by the company that controls and oversees the work, and certify the payment conditions for each subcontract contract at the time the agreement is concluded and throughout the entire length of the contract or agreement. The main company is required to communicate its subcontractor contracts to the controlling company when requested to do so by the latter.
