Finally the matters of consent (the positive agreement of a person), `assent’ (positive acquiescence) and refusal were addressed, as was the general applicability to the concept of Gillick competence as related to research. In terms of a child’s refusal: A reasoned refusal by a child to participate in research is likely to be taken as evidence of such understanding [Gillick competence], and it would be unwise to rely on parental consent in such circumstances.

The guidance contained in the document proved helpful for researchers and reviewers alike in achieving a balance between the protection of research subjects and the facilitation of ethically and scientifically valid research. It was radical in that it recognised the importance of children’s consent, involvement in agreement (assent) and refusal and in its approach to so-called nontherapeutic research. It was widely cited and became recognised educational and training material for RECs and researchers alike. Crucially, it presaged the wider involvement of children in the design, conduct and prioritisation of research as set out in the update of 2014 and the Nuffield Council’s 2015 report on clinical research with children (see below).
