Who May Be Sued?

A lawsuit may be filed against the immediate seller, the remote manufacturer, and every other defendant in the chain of distribution. If the immediate seller is sued, they will frequently seek indemnification from the manufacturer or maker. In other words, the consumer may sue anyone in the line of distribution.

Keep in mind that product liability cases are complex and require lawyers with experience and expertise trying these cases. Product liability is expensive because of the need to hire experts to establish defect. Frequently, the pretrial process of discovery is also expensive. If you have a strong case, you will need a specialist to litigate your claim against the manufacturer or other parties in the chain of distribution. A product liability lawyer will gather evidence substantial enough to show that the product was indeed defective and present the evidence in court.
