At the Constitutional Convention and later at the Virginia Convention, James Madison demanded the protection of property rights as a way of protecting “minorities” from the “majority.” Madison employed the suffering of slaves—he owned hundreds—as an example of how society’s majorities abused minorities. The minority Madison desired to protect was, however, the wealthy and often slaveholding minority and it is that minority protection that became a foundational principle of the founding fathers.242
