IMPROVE DOMESTIC VIOLENCE RECORDS IN THE BACKGROUND CHECK SYSTEM

The background check system is only as good as the records being fed into it. A report issued in 2016 by the United States Government Accountability Office indicated that many court records for abusers are missing from the background check system, and others aren’t flagged correctly. According to the report, the FBI completed 90 percent of denials involving misdemeanor crime of domestic violence convictions within seven business days.28 This was a longer time period than any other prohibiting category. When states submit records to the NICS, they aren’t required to flag records prohibiting a person from obtaining guns, causing delays in the background check process. Arrest records are often not updated to show whether the arrest was followed by a conviction, creating a need for further investigation. And as we learned before, if the investigation takes longer than three business days, the gun sale can proceed.

If the current background check system is unable to fulfill the requests for background checks within three days to comply with federal law, then either the system needs to be overhauled, or the law needs to be changed. Until then, law enforcement should be required to flag records that would prohibit the person from purchasing a gun. This would speed up the current system tremendously and make it more effective at the same time.
