Thatâs about all he had to say about Darren. Note that he couldnât bring himself to use words such as innocent or exonerated, though any reasonable person who reads the report could only conclude that the physical evidence indisputably verified Darrenâs account of the incident, and refuted every account alleging misconduct, criminal or otherwise, on Darrenâs part.
But this opportunity to heal a nation was eschewed and, instead, peppered with language implying that rather than Darren being innocent of wrongdoing, the DOJ just couldnât meet the evidentiary burden of proving he had committed a crime. Take note of phrases Holder seemingly uttered through clenched teeth, like, âthe determination about our inability to meet the required federal standard,â and âthe facts do not support the filing of criminal charges against Darren Wilson in this case.â Thatâs pretty general, General. Worse yet, it uses thinly veiled hints that Wilson is evading prosecution on a technicality. The technicality was incontrovertible witness testimony and physical evidence that demonstrated beyond the shadow of any reasonable doubt that Darren was free of guilt and acted as he had to that day, within the unmistakable confines of the law. At the press conference, Holder immediately pivoted to the pattern and practice investigation and went on a twenty-minute diatribe about so-called unconstitutional practices engaged in by the Ferguson Police. Then he did the unthinkable. In the middle of his remarks, he attempted to rationalize the actions of those who had rioted, looted, burned down buildings, shot at police, and otherwise engaged in criminal behavior:
Of course, violence is never justified. But seen in this context â amid a highly toxic environment, defined by mistrust and resentment, stoked by years of bad feelings, and spurred by illegal and misguided practices â it is not difficult to imagine how a single, tragic incident set off the city of Ferguson like a powder keg. In a sense, members of the community may not have been responding only to a single, isolated confrontation but also to a pervasive, corrosive and a deeply unfortunate lack of trust â attributable to numerous constitutional violations by their law enforcement officials â¦3
