Mark and I compared notes first thing the following morning. We were both satisfied that Avery was innocent, at least of this particular crime, and we’d have to release him. But Mark suggested that we check a few other things first. He would call Sherry Culhane and ask her to run a second DNA test just to make sure, and I’d call Keith Findley at the Wisconsin Innocence Project to discuss a time frame for Avery’s release.
The crime lab had also informed Keith about the DNA test results by the time I called him, and he’d already told Steven Avery the good news. He was anxious for his client’s release, but he understood our need for caution. I think he also appreciated the non-adversarial way that Mark and I were handling the case, not fighting him every step of the way when his only goal was to retest the evidence with new technology to make certain there had not been a mistake. Of course his client was anxious to be released, he’d been in prison for eighteen years for a crime he didn’t commit, but Keith said he would tell Steve they had to wait until the DNA results were confirmed, which shouldn’t be more than a week.
Keith also agreed to put a muzzle on his client and his family until the new DNA test confirmed his innocence. We all knew there’d be a media frenzy as soon as word of Steve’s exoneration got out, and everyone wanted to have their ducks in a row before the madness began.
Mark wanted to check one other thing just to make sure. We needed to confirm that Gregory Allen wasn’t in jail or prison somewhere on the day Penny Beerntsen was assaulted. So we called the Department of Corrections. Allen had served a stint in prison on a burglary conviction a few years earlier, but on the day Penny was assaulted, he was roaming the streets. Or more accurately, he was prowling the sands.
