Nobody, certainly, was willing to give them anything free. On January 20, 1959, the day before director Cecil B. DeMille died, Rose’s bid for a gigantic payday from Columbia Pictures was snubbed. Los Angeles County Superior Court Judge Kurt Kauffman was un-swayed by Abe’s argument that the studio had infringed on Lee’s copyrights. Abe had recited Lee’s own contractual wording to bolster their case. “This license shall apply only for public reproduction and performance in theatres or other places of public entertainment…” Columbia’s lawyers were more persuasive. They argued that Lee was a contractor already paid for his work and that TV was irrelevant. Gavel down. Between this ruling and the settlement with the Pasadena Unified school district over the accident, the Zahlers were 0-2 against the powers-that-be.
