Peter goes on to say on page A of your letter document, you begin by using a figure of 196 hours weekend allowance to be included in the calculation. The rota for the relevant period gives a figure of 195 hours and consequently the figure of £37.80 you have in your summary is incorrect. This statement is in my opinion untrue I took the rota to Mike Doyle and I got him to calculate the number of hours on the rota and he replied, ‘196 hours’.

Referring to the Bank holiday payments, you show 28 hours at double time when in fact this should be single time because the officer would already have been paid single time in the basic pay. This statement is also in my opinion an out and out lie as Bank holiday payments are paid at double time plus a day in lieu making it treble time, which the rest of the Council are paid.

Ref combination of rest days on Bank holidays which you have shown do not coincide with any rota on file and certainly do not represent the situation in 1991. I have the rota that security was working from in 1991 and it shows quite clearly that the combination of rest days does indeed coincide with the relevant rota. This rota was passed down to me by the ex shop steward, Colin Pinder.

For Peter to say prior to becoming responsible for market security the four officers involved were part of the regular rota and paid on exactly the same basis as the other officers on the rota, the four officers in question did not work as many hours, nor did they work shifts or Bank holidays, so why were they paid the same pay?

For Peter to say my understanding is that the protected earnings were paid for a commitment to increase weekend working and payment for Bank Holidays is also in my opinion untrue as protected earnings were paid when a job finished and the person was moved to another job that was less pay and not for increased weekend working and Bank Holidays.

For Peter to say ‘you suggest in your letter that the protection element was reduced to £50.65. I am advised that this did happen at the time when security officers received their annual increment. This is the way in which the Council administers a protection and guarantees that staff do not get a lower wage than at the point when the new structure began’. This is again in my opinion untrue as this is NOT how the Council administers a protection and how come the security officers were worse off by £244.20 a year and the four market officers were once again better off by £244.20 a year plus the £657.08 a year thanks to Mick Gornall.

Peter saying ‘Referring to the Head of Security’s letter to Mr K Nelson in December 1997, the figures were provided to indicate the element of protection to existing staff and nothing to do with the scale 3.
