October 12, 1933- After learning that Dillinger was being held in the Allen County Jail in Lima for the Bluffton robbery, the gangsters traveled to the jail. On a fateful Thursday evening the group arrived to liberate the man whom had assisted in their own escape. Pierpont, Makley, and Hamilton entered the Allen County jail around 6:30 p.m. Russell Clark and Harry Copeland remained in the car.

Allen County Sheriff Jess Sarber was seated at his desk reading. Mrs. Sarber was sitting nearby doing a crossword puzzle, and Deputy Sheriff Wilber Sharpe, not in uniform, was nearby on a couch. Pierpont walked up to the desk of Sheriff Sarber and said, “We’re officers from Indiana. We’ve come to take John Dillinger back to Michigan City”. Sarber responded to the request by asking, “Where are your credentials?”. Pierpont produced a revolver and proclaimed, “These are our credentials, turn him over”.

In an act of instinct, Sarber went for a revolver hanging on the wall in a holster. The gunman then fired one shot and Sarber fell to the floor. The lawman attempted to get to his feet, Makley then pistol whipped Sarber in the head. The three men demanded the keys to Dillinger’s cell. They then began to kick the severely wounded Sarber until Mrs. Sarber pled, “Let Dad alone, I’ll get the key!”. The woman obtained the key and gave it to the men.

Dillinger was playing cards with another inmate, Art Miller, when he heard the gunshot. He looked up and saw his friends leading Mrs. Sarber and Deputy Sharpe into one of the cells. The men then released John Dillinger and the four fled to the awaiting car. It was later said that Dillinger felt great remorse for the killing of Sarber, whom he admitted had treated him kindly. The regret by Dillinger in the Sherriff’s death indicates that the outlaw did indeed have compassion, and was not the “cop killing, crazed murderer” that authorities would attempt to portray to the press and the public in the future.

Deputy Sheriff Don Sarber, son of Jess Sarber, after returning from a trip, entered the office to find his father wounded on the floor.

Don was merely minutes late from running into the men responsible for the shooting of his father. The deputy immediately rushed to the cells to find his mother and Deputy Sharpe locked in the cell. He located the keys and released the two. Mrs. Sarber ran to her fallen husband, she cried in shock over her husband’s body. An ambulance was summoned and Jess Sarber was taken to Memorial Hospital in Lima. He arrived around 7:00 p.m.

Doctors determined that he had been shot in the stomach and a major artery was severed. At 8:05 p.m. Sheriff Jess Sarber, age 47, died of the gunshot wound.

Once again, Matt Leach took to the press to assign blame for the slaying. He returned to the claim of the seized maps. The mysterious maps the officer had never seen, nor had been confirmed to exist.
