The statement of the UK ICO that Bluetooth spam is no longer covered by PECR mentions that ‘the Regulations only apply to messages over a public electronic communications network and we have concluded that Bluetooth messages are not in fact sent using such a network’.17 The UK ICO argued that Bluetooth messages are conveyed over ad hoc peer-to-peer networks, called piconets, rather than over a public network.18 From this statement, we can thus derive the argumentum a contrario that ad hoc networks are not considered as public networks. Regrettably, however, the UK ICO did not go into details regarding the criteria needed to classify a network as public or non-public.
