Tips for Good Rules for Negotiations for Quantity Surveyors and Civil Engineers

1. Decide the strategy, take notes and prepare well expecting the worst case scenario.

2. Get to know the opposition,strengths and weakness,if possible.

3. Check legal entitlement of the claim.

4. Check all the facts referred to in the claim.

5. Be familiar with facts relating to the dispute.

6. Identify the relevant correspondence and records pertaining to the subject of the claim.

7. Prepare detailed response to the claim with appropriate back-up data, materials and have spare copies for distribution if required.

8. Discuss with the relevant people and fix agenda,with the required attendee and the time scale. Limit numbers attending the meeting.

9. Choose the negotiating team with care as the success of all negotiations depends largely on the suitability of the team.

10. All negotiations require face-to-face meetings. Meetings should always be without prejudice. All discussions at the meeting to be treated as confidential, should not be quoted elsewhere.

11. Attack the weak points in the claim.

12. Score points early in the negotiations.

13. Don’t appear too inflexible. Attitude of given tricks should be given.

14. Negotiation is a two way street. Be prepared to make concessions in response to the contractor making concessions.

15. Learn to think and reason under pressure.

16. Don’t abuse the opposition members personally.

17. Listen others arguments carefully, control emotions, don’t be too proud to admit when you are wrong.

18. Compliment the contractor when concessions are made.

19. Don’t allow the meeting to go on too long with focus to matters not in the agenda.

20. No smoking,or the use of chewingum in the meeting room. Respect for all cultures.

21. When overall agreement cannot be reached agree to partial agreements.

22. Always commit to have in writing all agreements reached at the meeting.
