The Best Kind of Claims for Employees

So even though the fired employee might shout threats about a wrongful-discharge lawsuit on his way out, his lawyer will quickly explain to him that his best available claim is probably an employment-discrimination claim.

One note: the employee may also have some form of wage claim, such as failure to pay proper wages or a failure to pay overtime. These are also good claims for employees, in that the relevant statutes usually provide for multiple damages and attorneys' fees. But they don't tend to have the high possible payoffs that winning discrimination claims can have. That's why discrimination lawsuits are often a disgruntled employee's weapon of last resort.
