Leaving the courthouse, the sheriff walked to his patrol car parked across the street. He spoke briefly into the radio. A few minutes later, Stringer and Collins pulled up and got out.
âWhatâs up?â Pratt Stringer stood in front of his sheriff, a serious look of concern on his face. Darcy Rhodes was not one for dramatics and the call to meet him without explanation was not in characterâ¦unless.
âFollow me.â Rhodes got into his car and cranked the engine.
âLooks like weâre doinâ itâ¦today.â Stringer looked at Bert Collins, who had walked up as the Sheriff gave the order to follow him.
âYep.â
The two deputies jumped into their vehicles and followed the sheriff rapidly around the courthouse square. Anyone watching, and everyone certainly was, would not know where they were likely to be headed until they turned down one of the streets leading out of the square.
The three Coline County cars pulled into the small lot at Perkinsâ Garage, blocking all entrance and exit to the location. Without a word, Darcy Rhodes walked into the service bay, followed by Stringer and Collins.
Fallon Burke was standing at a bench cleaning a carburetor that had been removed from one of the vehicles in the garage. He turned as the sheriff and deputies entered, wiping his hands on his shirt front.
âFallon Burke.â Rhodes walked directly to him, ignoring Elmore Perkins, coming out of the office. âYou are under arrest. The charge is murder.â He looked at Stringer. âCuff him, Deputy.â
âYes sir.â Stringer turned Burke around, searched him and pulled his arms behind his back one at a time.
âWhatâs goinâ on here?â Perkins took a step in the direction of the deputies, but Rhodes turned and gave a quick shake of his head, warning him not to interfere. Perkins stopped in his tracks.
There was no resistance. As the handcuffs ratcheted closed around his wrists, Burke grinned wickedly. âYouâre fuckinâ crazy. You know that? Crazy.â
Rhodes handed a slip of paper to Collins. âRead this to the suspect, Deputy.â
Puzzled, Collins looked at the paper. Heâd heard of this, but never seen it in Coline County. He cleared his throat and began.
âFallon Burke, you have the right to remain silent; anything you say can and may be used against you; you have the right to an attorney present before and during the questioning; if you cannot afford an attorney, one will be appointed for you.â
The case of Ernesto Arturo Miranda versus the Arizona Supreme Court had only been before the United States Supreme Court the previous year. Many departments, especially in the rural south were not yet up to speed in heeding the requirements of the Courtâs decision. It was called the Miranda Decision. As sheriff, Darcy Rhodes had received flyers from the FBI advising how the warning should be administered to a suspect. It was the first time his deputies had used the Miranda Warning, and he listened attentively to Collins, reading out the words he had personally typed. There would be no errors in this case, no mistakes.
âDo you understand what Deputy Collins just read to you?â Rhodes looked Burke in the eyes.
