This example illustrates the importance of complying with the deadlines for making expert disclosures under Rule 26(a)(2) and promptly supplementing them in accordance with Rule 26(e). The price tag for failing to do so, absent substantial justification and prejudice to the opposing party, is the harsh sanction of exclusion of the expert’s testimony. That could be fatal to the case of the party that ignored the disclosure/supplementation requirements of the Rules.
