The Marshall Court
John Marshall delivered the majority opinions in a number of critical decisions in these formative years, all of which served to strengthen the power of the federal government and restrict the powers of state governments.
Marbury v. Madison (1803): This case established the precedent of the Supreme Courtâs power to rule on the constitutionality of federal laws.
Gibbons v. Ogden (1824): In a case involving competing steamboat companies, Marshall ruled that commerce included navigation, and that only Congress has the right to regulate commerce among states. Thus, the state-granted monopoly was voided.
National Expansion
The Missouri Compromise (1820): The Missouri Territory, the first to be organized from the Louisiana Purchase, applied for statehood in 1819. Since the Senate membership was evenly divided between slaveholding and free states at that time, the admission of a new state would give the voting advantage either to the North or to the South.
As the debate dragged on, the northern territory of Massachusetts applied for admission as the state of Maine. The two admission bills were combined, with Maine coming in free and Missouri coming in as a slave state. To make the package palatable for the House, a provision was added that prohibited slavery in the remainder of the Louisiana Territory north of the southern boundary of Missouri (latitude 36° 30â²).
