In September 1875, Mitchell had reached the Barnsley Bed at his new colliery, Mitchell Main, in coal leased near Aldham Junction, below Swaithe Main; his partners were Mr Worms, the great Paris coal merchant, and H Josse of Grimsby. But Mitchell was claimed at the time to have been much affected by the Swaithe disaster of the end of that year; he was also a busy man as a Union Guardian, chairman of the Worsbrough Local Board, on the School Board and an active Freemason, until his death, in January 1876. He was buried in St Thomas’s churchyard and a Memorial Hall subsequently built at Worsbrough Dale. Mitchell was succeeded by his wife and their two sons, and it was from that, for £18,232, Tyas and Bartholomew bought Mitchell’s one-third share in Edmunds and Swaithe, in April 1878.

In February 1879 the partners turned the concern into a limited liability company, with the substantial capital of £125,000, but without participation by persons outside the two families concerned (Figure 7). The subscribers were:
