The duty to retreat at the center of controversy

The duty to retreat is one of the most controversial areas of American self-defense law. Some people see it as part of a never-ending political struggle between liberals and conservatives, between those who tend to favor collective responsibility and those who tend to favor individual responsibility, those who believe government should protect us versus those who believe we should protect ourselves. Others see it in economic terms: rich versus poor, people who can afford to hire bodyguards to protect them versus people who can’t. Still others see the duty as having racial overtones, an unfortunate truth, because some of the nation’s early gun laws were passed to limit African Americans from possessing firearms. Regardless of the political overtones, the duty to retreat is controversial because it requires behavior that many Americans find distasteful. Understanding it requires a short trip through a bit of English and U.S. legal history.
