16.18 Unextracted process, 1768. In a General Minute Book (CS16/1/132) under the date 27th January 1768 you find a case brought by Christian Allan, daughter to James Allan, late bailie of Hamilton, against John McNeill, schoolmaster in Hamilton. You look up the Unextracted Process card index and find ‘Allan, Christian v McNiel 1767 Adams Mack A1/101’. This number converts into CS229/A1/101 which you order out and find that the action was for non-payment of rent of a house owned by the pursuer in the Castlewynd of Hamilton. (You could then try the Register of Sasines in the hope of finding more information.)

16.19 Extracted process, 1796. Having searched for the name ‘Boak’ in the index to the 1796 printed general minute book (CS17/1/15), you find a case decided on 25 November 1796: James Boak AG[ainst] Isobel Gairns, spouse of Robert Boak at Pittendrech and Agnes Jarrow, wife of James Morrison, gardener at Gallowtown, representatives of deceased John Niccol, sometime merchant, thereafter sailor in Perth, their cousin. The clerk’s mark is H.S.S., and the guide to the marks tells you this belongs to a clerk in Dalrymple’s office. Next, look up the extractor’s minute book for Dalrymple’s office that covers 25 November 1796 (CS19/1/5), and verify the date the case was ‘extracted’. You can now find the decree in the Register of Acts and Decrees (CS18) and the case papers in the corresponding series of processes (CS21 – see 16.14).

16.20 Divorce cases were the responsibility of the Court of Session after 1830 and to find them up to 1912 you look initially at the printed minute books. You are looking for the divorce case of a couple named McKay. The index in the minute book for 1884 (CS17/1/103) leads you to an entry under the date 22nd January 1884, describing a decree of divorce in favour of Janet Rankin, or Lean, or Mckay, residing in Creetown, against James McKay, residing at Xenia, in the State of Ohio, in the United States of America. The minute also names their daughter, and his sister and mother, who live in Newton Stewart. As you want more information, you look up the index to Unextracted Processes and find a card ‘McKay, Janet Rankin or Lean or, v Mckay, Divorce 1882, 2P. Mc. 14/2’ which number converts into CS247/4184. You order out this process and discover that the defender went to America to gain employment but has not been heard of for several years.
