1 It is unclear whether the term probolē refers to the whole process, including the trial, or merely the preliminary hearing before the Assembly. In the latter case the plaintiff would then take the case to court in whatever public action was appropriate to the allegations. Though the fact that Demosthenes occasionally refers the term probolē to the Assembly hearing favours the latter view, it is also true that he never uses any term which would identify the court hearing as a separate action. He seems explicitly to rule out the most obvious action, the graphē hybreos (§§25–35), the indictment for ‘outrage’ (malicious assault), and the absence of a persistent emphasis on impiety rules out the graphē asebeias, indictment for impiety.
