Recommendation

The government agency conducted discussions with the contractor selected for contract award without holding discussions with the protester in three of the four cases discussed above. The GAO decision did not mention discussions with any offerors in the third case. Regardless of whether discussions were held with any other competing contractors, the government is required to conduct discussions with offerors whose proposals have been judged to be unacceptable to determine the acceptability of their proposals or provide an opportunity for the offerors to revise or modify their proposals in some material respect. Use of the recommended Figures 4.1 and 4.3 forms that could be produced through the recommended information technology application would guard against this infraction. Proposal evaluation team members completing either of the recommended forms will need to respond to the question regarding whether or not contractors are being afforded the opportunity to correct proposal deficiencies.
