There were two methods to form a municipal corporation, under the general law (which they shouldnât do) and by special act of the state legislature. Under the special act procedure, the state adopts for the municipality a charter which is specifically prepared for the desired purpose and which prevails over all general laws except where specifically made subject to general laws. If a change in the charter subsequently becomes necessary, it is generally necessary to go back to the legislature except in those situations where provision is made for a public referendum.
The charter will set forth the type of municipal government and desired administration. The municipality would also be entitled to various county and state refunds.17
