An example of a political conflict problem can be found in an endangerment finding whether the Environmental Protection Agency (EPA) has legal authority under the Clear Air Act to regulate carbon dioxide emissionsâin particular, whether the EPA has discretion not to regulate carbon dioxide emission for policy reasons under the Clean Air Act. That was released in the EPAâs 2009 legal opinion, which concluded that, because of its contribution to global warming, carbon dioxide in large amounts âmet the Clean Air Actâs definition of a pollutant that harms human It is the events leading up to final admittance that the EPA has authority to regulate the dioxide emissions that is the interesting and useful part.
The text of the Clean Air Act was first passed in 1963 before being amended in 1970, 1977, and 1990, and it does not refer to climate change or greenhouse gases. In 1999, Massachusetts and 11 other states petitioned the EPA for regulation of carbon dioxide (COâ) as an air pollutant. In 2003, the EPA denied the petition, arguing it did not have the legal authority under the Act to regulate carbon dioxide and other, similar gases as air pollutants. Now the political conflict: âIn addition, the EPA argued that if it did have the authority it would not regulate carbon dioxide because it would interfere with the George W. Bush administrationâs preferred policy approach to human-caused climate
