An example of a political conflict problem can be found in an endangerment finding whether the Environmental Protection Agency (EPA) has legal authority under the Clear Air Act to regulate carbon dioxide emissions—in particular, whether the EPA has discretion not to regulate carbon dioxide emission for policy reasons under the Clean Air Act. In 2003, the EPA denied the petition, arguing it did not have the legal authority under the Act to regulate carbon dioxide and other, similar gases as air pollutants.
