JOINT LEGAL CUSTODY

Parents with joint legal custody agree to share equally in decisions regarding their child’s education, religion, place of residence, health, and any other issues specified by their parenting plan. In some jurisdictions all divorcing couples are routinely assigned joint legal custody. In other places both parents must request it. In still other courts, one person’s request is sufficient.

Joint legal custody by itself has no bearing on where the child lives. It only refers to how the decisions affecting the child are to be made. As in sole custody, the children in joint legal custody can divide their time between Mom and Dad in many ways.

Interest in joint legal custody reflects the conviction of many people, including some judges and attorneys, that if a father and mother have equal authority for making decisions about their children, the father is more likely to pay child support regularly, in full and on time, and stay more involved with the kids. Actually, studies differ on this point. Some find a connection between payment of child support and joint legal custody; others do not. In general, payment of child support is related to whether a father holds a full-time job, whether he has the funds to pay, and whether there are effective enforcement methods in place.
