McCorvey (known as “Jane Roe” in this case) sued Dallas district attorney Henry Wade in a Texas federal court. The court ruled that the law violated the Constitution. Wade appealed to the Supreme Court.

The Supreme Court used similar reasoning to that in Griswold v. Connecticut to decide in favor of individual freedom. Using the principle of substantive due process, the Court concluded that abortion fell under the umbrella of privacy protections guaranteed by the Constitution. According to the Court, McCorvey had the fundamental right to end her pregnancy.

Pro-life and pro-choice supporters argue at a demonstration marking the thirty-third anniversary of the Roe v. Wade decision, which legalized abortion.
