II. The Judged and the Judges

A. The Community, Juries, Seat Judges, Captains and Judges of the Crown Council: What these Terms Signify

Following a study of the active exercise of ancestral Szekler customary law, we need to deal more formally with the persons involved; its actors and participants.

The phenomenon of ternarity characterizing the Szekler community extends into the casting of participants in the legal process. Like the three ranks of military hierarchy, the three components of the title comes trium generum Siculorum, a Szekler judiciary assembly was also composed of three levels of participation. There are the dignitaries (one), the members of the jury (two) and the community (universitas) (three). Does this composition really embrace the Szekler community in its entirety? In the course of time, some terminological evolutions can be observed in the designation of the jury members and the community. As representativeness shows signs of lessening, persisting generic designations recall time and again that the Szekler community is based on the all-pervading notion of equality.
