As the police were conducting numerous interviews, private investigator David Olmsted first met with the Stylers at the Aspenalt on Saturday, March 1, and they’d laid out for him Trey’s medical problems. They were waiting for his prescription to be filled at the City Market pharmacy in Aspen, but with their car impounded they didn’t know how to get into town and pick up the drugs. Olmsted said that he’d be happy to do this for them, but by the time he was able to run this errand, the pharmacy was closed. He suggested that on Sunday morning Nancy ask the Pitkin County deputy, who was conducting surveillance on the couple from her patrol car parked outside the Stylers’ motel room, to drive her into town. No matter what you do on the ride, Olmsted insisted, don’t say anything to the officer about Nancy Pfister or the past few days. She followed the PI’s advice, the deputy agreed to the plan, and Nancy was able to get the meds for her husband. On Monday, March 3, Olmsted had to leave town for the Pamela Phillips trial in Tucson, where he was working with the defense team. Before departing, he stopped by the Aspenalt and spent another hour with the Stylers. He had a sense of what was coming next.

“I hate to be the bearer of bad news,” he said to them, as the deputy continued watching their doorstep, “but don’t be surprised if they arrest you. If you do get arrested, don’t make any statements to anyone—especially to anyone inside the jail.”

Olmsted flew to Arizona and when he landed in Tucson, he had a message waiting from the lawyer in Boulder who’d first contacted him about the case. He didn’t have to pick up the message to know what had happened.

That Monday, Brad Gibson finished putting together an arrest warrant for Nancy Styler and submitted it to Ninth District Judge Gail Nichols. Another warrant was being prepared for Trey. The Pitkin County Sheriff’s Office had earlier shown similar warrants to the judge, but she’d asked them to gather more information before she’d sign them, as the case against the couple had been too thin. The deputies did as Nichols requested, until she was satisfied with the results.

“I have probable cause,” Gibson wrote in the final draft, “to believe that Nancy Styler conspired to and was complicit in the murder of Nancy Pfister. Nancy Styler had the motive to kill Nancy Pfister because the Stylers were experiencing significant financial hardship, they had an ongoing rental dispute involving thousands of dollars with Nancy Pfister, Nancy Pfister refused to allow the Stylers to retrieve their belongings until the rental dispute was resolved, Nancy Styler made comments to Kathy Carpenter that she was going to kill Pfister and that something bad was going to happen to her.”

Gibson also pointed out that in his interview with Kathy’s mother, Chris Carpenter, she recalled hearing Nancy Styler say that she was going to kill Pfister.
