The implied contract claim came under question recently when certain federal district courts in Los Angeles held that if a claim was based on the submission of material eligible for copyright—such as a screenplay—a claim for breach of implied contract was preempted (barred) by the federal Copyright Act. But then, in late 2004, the Ninth Circuit, the federal appeals court with jurisdiction over California, ruled in Grosso v. Miramax that a writer who submitted a screenplay to a studio (or, presumably, to any person or entity who traffics in such ideas in the regular course of business), could sue the studio for producing a movie containing ideas similar to those in the screenplay, even if the movie was not deemed similar enough to support a copyright infringement claim.
