Witness Statements

If you know of witnesses but have not spoken with them, or you have supportive information from witnesses but they have not yet given you a written statement, contact them again before too much time slips by. (See “Preserve Evidence of Fault and Damages,” in Chapter 3.)

Applicable Laws

If you haven’t yet checked to see whether there are any laws in your state that help to show that another person was at fault, now is the time to do so.

In vehicle accidents, your state’s Vehicle Code, also known as the rules of the road, may have a law clearly showing why the other driver was at fault. (See the liability section in Chapter 2.) If so, make a copy of that law to send along with your demand letter. (See “Preparing a Demand Letter,” below.)

In staircase or other premises accidents, your local or state building code might contain a rule that has been violated by the other person and that contributed to your accident. (See Chapter 2.)
