DECISIONS AND DISSENTS

After oral arguments, the justices take their time to issue a decision. They can spend weeks or months reviewing all the information in a case. When the justices are ready, they each cast a vote. The side with the most votes wins the appeal.

Once the votes are cast, the Supreme Court must write up its opinion. Usually, the Chief Justice selects a justice to write the opinion. When the ruling is very controversial or complicated, the Chief Justice often writes the opinion. That involves clearly explaining how and why the Court came to its decision—how it interpreted the language of the Constitution, what logic it used, and what precedents it followed. Following precedent means that the justices look back on previous Supreme Court decisions and use those as a guide. Finally, the justices who disagree with the opinion can also write dissents.
