The second national lockdown

The three tiers lasted just twenty-two days before rising case and death rates caused the government to sweep them away, replacing them with a national lockdown which came into force on Bonfire Night, 5 November 2020.25

The second lockdown would be significantly different to the first, and much less strict. Schools would remain open, and there were now a large range of exceptions, including being able to exercise with one other person. Another exception was that outdoor events of any scale would be permitted on Remembrance Sunday. Meanwhile, the exception for socially distanced outdoor protests had been removed. This contrast demonstrates well the priorities of the government – and that it believed unlimited outdoor events could be safe, but would be permitted only if they were important enough to the government. Priti Patel, the Home Secretary, was said to have been directly responsible for the removal of the protest exception, perhaps swayed by the fact that anti-lockdown protests were happening throughout Europe, including in London. The Home Office noted the right to peaceful protest being ‘the cornerstone of our democracy’, but said that ‘any gathering risks spreading the disease, leading to more deaths’.26 And so protest was banned, apparently on the direction of the Home Secretary. Or was it? The High Court would be forced to answer that question a few months later.
