39. Brushing Away Tears

Alice made her final sweep around the bar, checking windows wiping tables, sweeping the sand back outside. Throwing the rag in the sink under the counter, she went into the backroom and stopped.

Stacks was huddled over the small preparation table, papers scattered across its surface. He lifted one, peered at it closely, took a pencil from behind his ear and made a mark on it, then picked up another. His movements were hurried and nervous as if he were searching unsuccessfully for the answer to a riddle.

“What you studying?” She smiled, put a hand on his shoulder for a second and took a seat across from him.

“Damned if I know.” He shook his head and pulled off his glasses. “Nothing maybe.”

She reached across and lifted one of the sheets. It was a printout of a section of the Florida Code.

“Eminent domain.” She read the words out loud and looked at him. “Want to talk about it?”

“Not much to say.” He fished through the papers and pulled out the ones that had come in the envelope from the county. “Here.” He pointed to a numbered item on a page that he had circled with a bold pencil mark.

“Discussion and possible approval of a proposal for the county commission to purchase for fair market value, and in the interests of the county and its citizens for the sake of public improvement and economic benefit, the property described as…” She skimmed through the legal description. “…otherwise known as Digger Key and all of its appurtenances, outbuildings, and facilities, to authorize an appraisal to determine said fair market value, and all matters related thereto.” She looked up at Stacks. “This mean what I think?”

He nodded. “They are going to take the key away from me.”

“Can they do that?”

“It’s been done before.”

“Then what? So they take it…what are they going to do with it?”

“Sell it off to Grantham and his partners, no doubt…for the sake of public improvement and economic benefit.” His lips twisted into a smirk. “Economic benefit for Grantham.”

“That’s bullshit.”

“I agree with your assessment of the situation.” He shrugged and pushed the papers on the table with his fingers as if her were stirring the soup.

“What are we …you…going to do?”

He smiled. “Fight.” He shook his head and rubbed his eyes. “But it won’t do any good. They have the votes already. Grantham would have made certain of that before letting this go to the county commission.”

“You mean he bought them off?” She shook her head. “Does that kind of thing actually happen?”

“You know, for someone who has been around as much as you have, Sam you can be pretty naïve.” He nodded. “Yes, it happens. They only need to buy one or two. They’ll have enough votes.”

“That’s not legal.”

“Hah.” His laugh was sharp and brittle. “There’s that naïve streak again.”

They sat staring at the pile of papers lost in thought. After a minute, Alice raised her head.

“We need a lawyer.”

“No shit.” Stacks smiled and shook his head. “Not in the budget.
