So Church had to have known, in her own words, that “her goose was cooked.” She later denied having said these words, but it is clear she knew that criminal indictments and prosecutions were likely. However, when they came, she—and her partners in crime, Billie Cherry and Michael Graham—decided to fight them, at least initially.

Church I

As recounted at the end of the first chapter of this book, Church and Graham were indicted for obstruction of a federal bank examination on November 10, 1999—less than two and a half months after the bank failed.1 The indictment contained three counts. Counts Two and Three were for the two separate days they buried bank documents on Church’s ranch. Count One was for conspiracy to obstruct the examination and listed a number of “overt acts,” including:

Church and Graham removing documents from the bank and concealing them from examiners;

Church and Graham burying bank documents in the ground so the examiners could not review them;

Church directing employees of the bank to disable the microfilm reader at the bank so that the examiners could not view certain bank records;

Church having employees of the bank sign a document containing false and misleading information and presenting the document to the examiners;

Church requesting one of her employees to dig a large hole on August 12,1999 on the C&H Ranch;

Graham removing records from the bank and from a storage location on August 12, 1999, and personally participating in loading the records on to trucks to be taken to the C&H Ranch;

Church personally directing one of her employees to dig another hole on August 15, 1999 on her ranch and directing him to bury bank documents in the hole;

Church, the week prior to the closing of the bank, directing one of her employees to remove boxes of documents from her office at the C&H Ranch; and

Church, two days before the bank failed, removing records from the bank and concealing them at her home.
