The third period: 2005–2008.

The third period from 2005 to 2008 was characterized by Ukraine’s active preparation and accession to the WTO. In January of 2005 Ukraine signed protocols with twenty-nine more WTO member states on access to commodity and services markets, and in February 2006 received the market economy status. In the same year the USA lifted the Jackson–Vanik amendment,2 which restricted trade with the ‘socialist bloc’ countries such as Ukraine. The fact is that according to the amendment, the most favored nation (MFN) treatment can be extended only to those countries with non-market economies in which the emigration regime has been acknowledged as liberal. The USA imposed sanctions against violators of international regulations, mainly relating to restrictions against the admission of goods produced in that country to the American market. Therefore, lifting the application of the amendment with regard to Ukraine was an important step, demonstrating the US Congress’s support of the economic and political changes in Ukraine.

Ukraine signed an agreement with the USA on mutual access to the goods and services markets. In 2006 negotiations with forty-nine out of the fifty members of the Working Group were completed. During this period Ukraine passed about thirty-eight laws necessary for accession to the WTO. The main changes made to the Ukrainian legislation in this period (2005–2008) concerned the regulation of export and import operations, agriculture, and the access of foreign companies to the Ukrainian services market – for example, the laws of Ukraine dated September 8, 2005 (No. 2860-IV: On Peculiarities of Government Regulation of Business Activities Related to Sales and Exports of Timber) and dated December 13, 2006 (No. 441-V: On Rates of Export Duties for Scrap of Alloyed Ferrous Metals, Non-Ferrous Metals and Semi-Finished Products, Using Them). The law on State Support of Ukraine’s Agriculture was brought into line with the WTO and EU requirements in regard to definition and clarification of terms, as well as regulation of import and export operations with the objects of state price regulation. The regulation of import to the Ukrainian customs territory and first registration of imported vehicles or those that were manufactured in Ukraine, as well as the gradual introduction of international environmental requirements for vehicles in Ukraine was recorded in the law of Ukraine dated July 6, 2005 (No. 2739-IV: On Some Issues of Import to the Ukrainian Customs Territory and Registration of Vehicles). Changes were made to the law On Milk and Dairy Products in terms of abolition of export subsidies for milk and dairy products, and the provisions of the law On Foreign Economic Activity were brought into conformity with WTO agreements. The law of Ukraine On Banks and Banking Activities was improved to allow foreign banks to open branches in Ukraine, and so on.

In 2007 the last protocol on access to the goods and services markets (with Kyrgyzstan) was signed. Thus, the phase of negotiations on Ukraine’s accession to the WTO with all Working Group members was completed. Despite President Viktor Yushchenko’s statement of December 20, 2007,
