Infectious disease prevention with minimum restrictions on rights. Section 111 of the Act requires that âthe spread of an infectious disease should be prevented or minimised with the minimum restriction on the rights of any personâ.
A 12-hour limit
190(6) of the Act states that âA direction under subsection (1)(b) to remain at any particular premises may be extended as many times as is reasonably necessary for the purpose of investigating, eliminating or reducing the risk to public health but so as not to exceed a continuous period of 12 hoursâ.
By the way, I want to flag here my concern with the precautionary principle in Section 6 of the Act regarding which I will comment in the last chapter.
In my opinion, most pandemic directions issued by the Chief Health Officer to date violate Victoriaâs laws perhaps except those in which he may have thoroughly justified the intervention â but Iâm not aware of any.
On 29 September 2020 it was reported that: âAsked why he would require Victorians to wear masks when there is no health purpose, Mr Andrews dismissed the question. âThatâs an esoteric debate, isnât it? Maybe there will be a time when we have the luxury of having those debates.ââ68 Daniel Andrews has obviously not a shred of respect for Victoriaâs laws.
Expectedly, there has been a large inconsistency in enforcement. While walking in the park I am generally at a distance from other people that is vastly greater than Daniel Andrews (or his Chief Health Officer) is from journalists during his press conferences. But neither he nor his CHO wear a mask during these briefings.
Apparently, an exemption from wearing masks has been provided for media briefings because the hearing-impaired need to read lips. Thatâs all very reasonable and Iâm sure the CHO has peer-reviewed proof that proves in lab settings that this virus is particularly dangerous when I, Sanjeev Sabhlok, walk in the open air tens of metres from others but is intelligent enough to distinguish Daniel Andrews from others, and that when Mr Andrews opens his mouth the virus gets out of his way and goes back into its nano-sized shell. And the less said about the millions of dollars in fines that have been is - sued in Victoria, the better. Many fines are not being waived by the police on appeal despite legitimate reasons.69 While citizens have the right to go to the Magistratesâ Court to challenge a fine, I have not heard of many such challenges. Instead, some people on social media seem to think that hearings are being somehow obstructed. That seems unlikely to me but it is a matter for further investigation. I would imagine that no Magistrate would tolerate the mandates being issued by the CHO today which are not accompanied by appropriate justification.
My public condemnation of police brutalities
The mandatory mask decree in open spaces was the direct cause of events that led to widespread police brutalities in Victoria. These brutalities distressed me enormously. Even more distressing was that Daniel Andrews did not raise his voice against them.
