Mason reached to an inside pocket, pulled out a folded legal document, took out his fountain pen, wrote the name “Orval Kingman” in a blank and handed the document to Kingman.

“What’s this?” the man asked, unfolding the paper to look at it.

“That,” Mason said, “is a subpoena duly issued under the sea! of the court, ordering you to appear at two o’clock this afternoon as a witness on behalf of the defense.”

Kingman’s face darkened. “I’ve tried to tell you and tell you nice,” he said.

“And I’ve tried to tell you and tell you nice,” Mason told him. “You give me a list of the men who were in that poker game with you and I’ll check. Otherwise, you’ll go on the stand and tell where you were on the night of the fifth.”

You’re bluffing,” Kingman said. “You aren’t going to put on CTV evidence. No smart lawyer ever puts on evidence on behalf of the defense at a preliminary hearing.”

Mason shrugged his shoulders. “You’ve got your subpoena. Be there at two o’clock this afternoon. If you think I’m bluffing 1h;s vvil! be a good way to find out.”

: Now, wait a minute,” Kingman said. “Let’s not get each other wrong. I…”

“You have your subpoena,” Mason said. “If you want to get out of testifying temporarily you can give me a list of those names.”

Kingman’s face darkened, then abruptly he pulled a notebook from his pocket, started writing.

“There are five names,” he said, tearing the sheet from the notebook and handing it to Mason, “Those people wouldn’t like it if they thought I’d given you the information. But if you want to check with them quietly and confidentially you’ll find out where I was on the night of the fifth.
